The current situation involving Julian Alvarez, Atletico Madrid, and FC Barcelona is one to keep an eye on this summer. Despite the fact that both La Blaugrana and the Argentinian forward are willing to join forces, Atletico Madrid remains strongly against the whole idea.
They want to retain the services of the player, but the striker himself wishes to leave and has even publicly stated this fact. Yet, with the Madrid-based outfit creating a huge hurdle for both willing parties, there is a possible legal approach that could be taken by the player himself.
According to Mundo Deportivo, the current dispute falls under the jurisdiction of the Spanish Football Federation (RFEF). In particular, a certain Article 16 of the Royal Decree 1006/1985 could be used here to help terminate the contract of a player who is actively aligned with a certain club at this moment.
It states that if a player wishes to terminate their contract without any fault attributable to the club, said club is entitled to compensation. Under normal circumstances, that amount would likely be accepted to be the €500 million release clause that is actively in place for Alvarez’s contract, but certain circumstances could lead to the court deciding what a fair compensation for the player would be.
This could lead to a rather unusual scenario, in which Julian Alvarez could unilaterally terminate his contract with Atletico Madrid and join Barça without the need for the immediate payment of a release clause or transfer fee. Instead, Barcelona would have to pay an amount that would later be decided by the Spanish courts.
However, even Barça themselves would become liable in this case since if the player ends up joining them within one year of his contract termination, La Blaugrana will have to pay up whatever amount is deemed to be an adequate compensation to Atletico Madrid.
Furthermore, as per this legal interpretation, the RFEF would ensure that the player’s necessary documents and registration are processed timely even before the compensation amount is determined. This is done to ensure that the player’s right to work is not jeopardised.
Still, it must be kept in mind that this is a highly unlikely scenario and may likely only be a last resort of sorts. Until then, the club continues to wait patiently as reports simultaneously emerge suggesting that a new offer could be in the works for Julian Alvarez.
